Heather L. Phillips

BIOGRAPHY

Heather Phillips is a litigation associate at Kelly Hart representing clients in high-stakes commercial lawsuits and complex business disputes. Prior to joining Kelly Hart, Heather represented clients in construction, business, real-property, and energy disputes, bringing specific experience in construction defect and mechanic’s lien matters, and oil and gas disputes. Heather has experience representing clients through all stages of litigation, from early case evaluation through trial. She works closely with clients to understand their goals and develop practical strategies for pursuing favorable outcomes in and out of the courtroom.

Heather graduated summa cum laude from Texas Wesleyan University with a Bachelor of Science in Political Science, and earned her J.D., cum laude, from SMU Dedman School of Law. While in law school, Heather interned for Judge Jeffrey Cureton at the U.S. District Court for the Northern District of Texas.

Originally from San Diego, Heather has lived in Fort Worth since 2001 and is proud to call it home.

EXPERIENCE AND HIGHLIGHTS
  • Represented oil and gas companies in disputes involving mineral interests, and oil and gas contracts, including mineral deeds and assignments, surface use agreements, farmout agreements, and gas gathering and purchase agreements, among others. Obtained multiple favorable settlements
  • Secured summary judgment in favor of a real estate developer in connection with a contract dispute over the purported sale of property valued at approximately $16 million
  • Successfully defended general contractor against summary judgment in connection with construction defect, breach of contract, and related statutory claims
  • Secured summary judgment in favor of real property owners enforcing their rights under a real estate contract
  • Obtained favorable jury verdict against insurance company in connection with coverage dispute and related statutory claims
  • Represented global energy company in numerous oil and gas disputes, including matters involving mineral interests, oil and gas contracts, and toxic tort litigation. Obtained multiple favorable settlements
  • Obtained settlement of approximately $1.5 million in favor of energy company in connection with claims for breach of a farmout agreement
