Roger C. Diseker

BIOGRAPHY

Roger C. Diseker has extensive experience in both federal and state court representing clients in a variety of matters, including, among others, complex commercial litigation, copyright, trademark and other intellectual property litigation, coverage disputes against insurers, commercial real estate disputes, premises liability, natural gas lease disputes, and legal malpractice defense. Mr. Diseker tries cases in both state and federal courts and argues appeals at the U.S. Fifth Circuit Court of Appeals and various Texas state appellate courts.

EXPERIENCE AND HIGHLIGHTS
  • First chaired a successful jury trial against employee seeking $6 million for workplace injury
  • First chaired jury trial on fraudulent real estate transaction, resulting in a take-nothing jury verdict for the client
  • Briefed arguments in suit successfully vacating arbitration award
  • First chaired jury trial on employee claim for injuries, resulting in twenty-two minute jury verdict for client
  • Briefed trial and appellate arguments in $45 million contempt action against major airline’s illegally striking pilots union. American Airlines, Inc. v. Allied Pilots Association
  • Briefed and argued appeal in defamation case brought by sitting district court judge against local television station
  • Trial and appellate briefing on issue of whether defendant was fraudulently joined to defeat diversity jurisdiction in a $38 million tax indemnity suit
  • Second chaired and handled all trial and appellate briefing for defense of a landmark Americans with Disabilities Act case concerning whether a jazz bar could be forced to ban smoking to accommodate a patron with cystic fibrosis
  • Assisted in preparing case, including briefing and arguing legal issues in a plaintiff’s malpractice claim against a home health care provider resulting in a negligence and punitive damages finding of $4.2 million
